OFFICIAL RULES

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.  A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCE OF WINNING.

1. HOW TO ENTER

1. These rules govern the Blarney Stone Broadcasting “Q100 Michigan Mobile App Shout Out” Contest (the “Promotion”) being conducted by Blarney Stone Broadcasting WQON 100.3 FM (the “Station”), which will begin at 12:01 am Eastern Time (“ET”) on 11/04/24 and will end at approximately 11:59 pm on 12/31/24 (“Entry Period”). 

2. To participate in the Promotion, you may enter via the following method:

• Download, update or open the Q100 Michigan APP on your mobile phone.  Open the APP and access the Shout Out feature with the microphone icon through the APP menu or tap the microphone icon in the menu bar at the bottom of the APP.  Enter your name, location (city), phone number and email address.  Tap the mic button to record a :15 (15 second) Shout Out then tap the upload button.  Shout Out must include Q100 Michigan and why Q100 Michigan has saved rock & roll for you.
• The Q100 Michigan APP must be installed on entrants smartphone.  The Q100 Michigan App can be downloaded for FREE on iphone and Android phones by searching Q100 Michigan in the APP stores for each device.  A link to the Google Play and Apple APP Stores can be found on the homepage at Q100Michigan.com.  Individual carrier, network and/or data use charges may apply.
• All Shout Outs submitted may be played on the air.  A Shout Out played on the air does not increase odds of winnings a prize.  All Shout Outs submitted must adhere to a radio-friendly and respectful tone.  Themes containing explicit language, violence, hate speech, or any forms of discrimination or political comments are strictly prohibited.  Submissions must not contain any content that infringes upon the intellectual property rights of others.  Any entry that violates these rules or is deemed inappropriate will be disqualified.
• By participating in the Promotion, each listener agrees to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Promotion without financial or other compensation.

• Entries submitted will not be acknowledged or returned.  Use of any device to automate entry is prohibited.  Proof of submission of an entry shall not be deemed proof of receipt by Station.  The Station is not responsible for (i) lost, stolen, mangled, misdirected, postage due, illegible, incomplete or late entries; (ii) telephone, internet or mobile service outages, delays, busy signals, facsimile transmission errors, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call, accessing the Facebook platform, Q100 Michigan APP or APP stores or from sending a text message (if applicable, message and data rates may apply)  The Station is not responsible for any fees incurred by an entrant for this method of entry; or entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technical difficulties. The Station is not responsible for telephone or internet service outages, delays, equipment malfunctions and any other technological difficulties that may prevent an individual from calling or contacting the station.

3. Individuals may enter multiple times during the Contest, but may only win once.  All entries must be received by 11:59 PM ET on 12/31/24.

2. ELIGIBILITY RESTRICTIONS

1. The Promotion is open to all persons who are 18 years of age or older and who are legal Michigan residents.  Employees of the Station, its licensee, and each of their respective parent, subsidiary and affiliated entities, Station advertising and promotional agencies, its participating sponsors, other radio stations in the Northern Michigan area, the members of their immediate families (spouse, parent, sibling or child) and those living in the same household of each (whether related or not), are ineligible to enter or win.  This Promotion is subject to all applicable federal, state and local laws and regulations and is void where prohibited.

2. Only one (1) qualifier per household is permitted in any Station-conducted promotion.  Listeners are eligible to win a prize valued at $600 or more in a Station-conducted promotion only once every six (6) months.

3. The winners may be required to present valid government-issued photo identification and sign and return any required Affidavit of Eligibility and/or Liability/Publicity Release in order to accept the prize.

4. Entrants are required to provide truthful information and the Station will reject and delete any entry that it discovers to be false or fraudulent.  The Station will disqualify any entry from individuals who do not meet the eligibility requirements.  The Station will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

3. PRIZES          

1. Two (2x) total prizes:  Each prize is (1x) $100 cash prize.   Approximate Retail Value:  $100 each. Checks will be issued by Blarney Stone Broadcasting to each prize winner.

Prize winners will be solely responsible for all insurance requirements, tie, taxes and all other fees and expenses not specified herein associated with the receipt and use of the Prize.  Prize shall be awarded “as is” with no warranties, representations, or guarantees, express or implied, with the exception of any standard manufacturer’s warranty that may apply to the Prize.   Any qualifying prizes or prize certificates must be picked up at the office of the Station at the address below.  The winners will forfeit any prize or prize certificate not claimed within 30 days, or earlier for time sensitive prizes, at Blarney Stone Broadcasting, 6514 Old Lake Road, Grayling, MI  49738. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior verbal consent of the winner and therefore, winner assumes the risk of its loss.  The Station is not responsible for the safe arrival of a prize or prize certificate.

4. There is no substitution, transfer, or cash equivalent for prizes, except that Station may, at its sole discretion, substitute prizes of comparable value or cash.  The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses.  Other restrictions may apply.

4. WINNER SELECTION AND NOTIFICATION

1. Decisions of Station management with respect to the Promotion is final.
2. Four prize winners will be determined by random drawing from all eligible entries received as follows:

Winner #1 (November):  Entries received from 11/04/24 – 11/30/24 will be announced on Monday, December 2, 2024 between 10AM – 2PM

Winner #2 (December):  Entries received from 11/04/24 – 12/31/24 will be announced on Thursday, January 2, 2025 between 10AM – 2PM

Winner #3 (January):  Entries received from 11/04/25 – 01/31/25 will be announced on Monday, February 3, 2025 between 10AM – 2PM - NO WINNER ENTRY PERIOD UPDATED

Winner #4 (February):  Entries received from 11/04/25 – 02/28/25 will be announced on Monday, March 3, 2025 between 10AM – 2PM - NO WINNER ENTRY PERIOD UPDATED

Winners need not be present to win.  Winner will be contacted by email and/or phone within 24 business hours of drawing.  If the winner does not respond in 10x business days an alternate prize winner may be selected from eligible entries.

4. Winners do not need to listen to the Station to win.

5. Odds of winning depend on the number of entries received by each deadline. 

6. Winners must sign any required Affidavit of Eligibility/Release of Liability Prize Acceptance Form at the time of delivery or prize will be forfeited and, if time permits, an alternate winner may be selected in a random drawing of all remaining eligible entries received.

5. CONDITIONS

1. Payments of all federal, state and local taxes are solely the responsibility of the winners.  Winners will be required to complete and submit an IRS Form W-9 with full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station.  Failure to submit a complete W-9 or equivalent will result in forfeiture of the prize.

2. By participating in the Promotion, each listener agrees to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Promotion without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to such acceptance of the prize.

3. Prior to being allowed to accept any prize or prize certificate, the Station in its sole discretion may require the submitter of a winning entry to sign a liability release, agreeing to hold the Station, its corporate licensee, its parent, subsidiary and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the Promotion.

4. If for any reason this Promotion cannot be executed as planned, including, but not limited to, as a result of severe weather conditions, national or local health crisis, pandemics, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Station that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Promotion, or if the Promotion is compromised or becomes technically corrupted in any way, electronically or otherwise, the Station reserves the right to cancel, terminate, suspend, or modify the Promotion.  If the Promotion is terminated before the original end date, the Station reserve the right to select the winner by random drawing from among all eligible non-suspect entries received as of the termination time/date or otherwise modify the procedure for selecting winners.

5. The Station, in its sole discretion, reserve the right to disqualify any person tampering with the entry process or the operation of the Station’s website.  Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes.  If the Station makes a good faith determination that an entrant has cheated or committed fraudulent activity in connection with a Promotion, the Station reserve the right to disqualify that entrant from entering and/or winning future Promotions and to prosecute and seek damages to the fullest extent permitted by law.

6. The Station reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize of equivalent value, which will become effective upon announcement.  If due to circumstances beyond the control of the Station, any competition or prize-related event or travel is delayed, rescheduled, postponed or cancelled, the Station reserves the right, but not the obligation, to cancel, terminate, suspend, or modify the Promotion and shall not be required to award a substitute prize.

7. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion or in the announcement of a prize.

8. 6. PRIVACY

1. By use of the Station’s website or by entering the Promotion through the Station’s website, mobile APP and/or Facebook page, you agree to the website’s Terms of Use Agreement located at http://www.q100Michigan.com and to the use of your personal information as described in the Privacy Policy located at http://www.q100Michigan.com.
